Partner program terms
These terms apply to everyone in the Evolve AI Institute partner program. Applying to the program means you accept them.

1. The program
Evolve AI Institute ("we") pays approved partners ("you") a commission for paid orders that customers place after following your referral link. You take part as an independent contractor. Nothing in these terms makes you our employee, agent, or legal partner, and you may not make promises or sign agreements on our behalf.
2. Applying and approval
You must be at least 18 and able to enter a contract. We review each application by hand and may approve or decline it at our discretion. Your account information must be accurate, and each person may hold one partner account.
3. Referral tracking
- Your referral link has the form
https://www.evolveaigo.com/r/yourcode. When a visitor follows it, our website stores your code in a cookie for 60 days. - An order is credited to you when the cookie is present at checkout. If the visitor followed several partners' links, the most recent link receives the credit.
- We do not set the cookie for visitors whose browsers send a Global Privacy Control or Do Not Track signal. Orders without the cookie cannot be credited, and we cannot add credit to an order afterward.
- Our records of clicks, orders, and commissions are final, apart from errors we correct.
4. Commission
- You earn $50 for each credited order once its payment is confirmed, whichever product option the customer buys.
- No commission is earned on orders you place yourself, orders from your household or a connection you use, orders paid with your payment details, or orders for resale.
- We may hold a commission for review when an order appears connected to you. We complete reviews within 60 days and release or decline the commission.
5. Hold period, refunds, and chargebacks
- Each commission becomes payable 45 days after the order is paid.
- A commission is cancelled when its order is fully refunded or charged back. If the commission was already paid, we subtract it from your next payout.
- If we win a chargeback dispute, the commission is restored.
- Partial refunds do not change a commission.
6. Payouts
- We pay through PayPal, in US dollars, to the PayPal address on your account page. You are responsible for any fees PayPal charges you to receive or convert the money.
- We pay payable balances of $50 or more, usually once a month. Smaller balances carry forward.
- We need a completed tax form before your first payout (see section 7).
- If a payout fails because the PayPal address is wrong or cannot receive money, the amount returns to your balance until you correct it. If PayPal cannot pay you in your country, we will work with you on another lawful method. Money that stays unclaimed is handled as Texas unclaimed property law requires.
7. Taxes
You are responsible for taxes on your commissions. Before your first payout, provide a valid tax form: Form W-9 if you are a US person, or Form W-8BEN (individuals) or W-8BEN-E (entities) if you are not. Upload it on your account page, where it is encrypted when stored; please do not send tax forms by email. We hold matured commissions until we have a valid form and pay them in the next payout after that. We may verify your taxpayer identification number with the IRS, we issue Form 1099-NEC or other tax reports where the law requires them, and we withhold tax, including backup withholding, when the law requires it.
8. Disclosure
Wherever you share your link, say clearly and close to the link that you earn a commission when people buy through it. For example: "I earn a commission if you buy through this link." Disclosures must be easy to see on phones and in videos, and they must appear in the content itself, close to the link. This follows the Federal Trade Commission's Endorsement Guides.
9. Following the law, and prohibited activities
You must follow every law that applies to how you promote us, including the FTC Act and Endorsement Guides, the CAN-SPAM Act for email, the Telephone Consumer Protection Act for calls and texts, and privacy laws. Do not collect personal information from people on our behalf. The following are not allowed:
- Spam, including unsolicited email, text messages, and direct messages, or posting your link in places that do not permit it.
- Paid search or social ads that bid on "Evolve AI," "Evolve AI Institute," "evolveaigo," or close variations, or ads that send people straight to your link.
- Coupon, deal, cashback, or incentive sites, and offering customers money or gifts to use your link.
- Cookie stuffing, hidden links, pop-ups, automated clicks, or anything else that credits orders the customer did not intend.
- Websites, accounts, or emails that could be mistaken for ours, including domains that contain our name.
- Content that is unlawful, hateful, harassing, or sexually explicit, or that targets children.
- Sharing student information of any kind while promoting the product.
10. Describing the product
Describe the Educator Edition only in ways our website supports. In particular, it runs on compatible Windows computers, its grading accuracy has not been independently validated, and every AI-generated draft or proposed score requires educator review. Do not claim results, endorsements, or features we have not published.
11. Our name and materials
While you are an approved partner, you may use our name, logo, screenshots, and product descriptions to promote the program, as long as you do not change them in a misleading way. This permission ends with your participation.
12. Ending participation
- You may leave at any time through the contact form.
- We may suspend or end your participation at any time, with notice to your account email. If we end it because you broke these terms, unpaid commissions connected to the violation are forfeited.
- Otherwise, we pay commissions earned before the end date once they pass the hold period, including a final balance below the usual minimum.
- When your participation ends, remove our name, logo, and your referral links from your content within 30 days.
13. Indemnification
You will defend, indemnify, and hold harmless Evolve AI Institute and its owners and employees from third-party claims, government investigations, and related losses, fines, and reasonable attorneys' fees, to the extent they are caused by your promotional content, your breach of these terms, or your violation of law, including advertising, disclosure, email, text-message, and privacy laws. This does not cover claims to the extent caused by our own negligence, misconduct, or breach, by our product, or by materials we provided that you used as permitted. We will tell you promptly about any claim, let you control the defense with counsel we reasonably accept, and cooperate at your expense. You may not settle a claim in a way that admits fault for us or binds us without our written consent.
14. Limits of liability
The program, the dashboard, and our tracking are provided "as is." We do not promise that tracking will be uninterrupted or error-free, or that you will earn any amount. To the extent the law allows, neither of us is liable to the other for indirect, incidental, special, or consequential damages or lost profits, and our total liability to you under these terms is limited to the commissions you earned in the 12 months before the claim. These limits do not apply to your indemnity obligations, to unpaid commissions you have earned, or to fraud or willful misconduct.
15. Disputes and governing law
- These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.
- Before either of us files a claim, we will try to resolve the dispute informally. The party with the concern sends a written description to the other (you through the contact form; we to your account email), and we both try in good faith for 30 days to resolve it.
- Either of us may bring an individual claim in small claims court if it qualifies.
- Otherwise, the state and federal courts in Harris County, Texas, have exclusive jurisdiction, and we both consent to their personal jurisdiction. These terms contain no arbitration requirement.
- If you disagree with a statement on your dashboard, tell us within 60 days of the payout or reversal it shows.
16. Changes
We may change these terms or the commission amount. We will email active partners at least 14 days before a change takes effect, and the change applies to clicks and orders after that date. Continuing in the program after a change means you accept it. If you do not accept a change, you may leave the program before it takes effect, and section 12 applies.
17. General terms
- Assignment. You may not transfer your partner account or these terms without our written consent. We may assign them to a successor to our business.
- Notices. We send notices to your account email. Send notices to us through the contact form.
- Entire agreement. These terms and our website privacy notice are the entire agreement about the program and replace earlier discussions about it.
- Severability and waiver. If any part is unenforceable, the rest remains in effect. Not enforcing a term at one time does not waive it.
- Survival. Sections 6, 7, 12, 13, 14, 15, and 17 continue after your participation ends.
