Terms of sale

The plain-language terms for buying a drive, an Evolve Everyday stick, an additional edition, or an update from us.

These terms apply when you buy from Evolve AI Institute (“we,” “us”) through evolveaigo.com or by invoice. Paying for an order means you accept them. Our returns, shipping, and support policies are part of these terms.

1. What you are buying

A drive order is a portable USB drive set up with one edition of your choice, any additional editions you buy with it, the local AI models those editions use, and Everyday Assistant and Image Studio. Each product page describes what an edition does, the computers it is meant for, and its known limits.

An Evolve Everyday order is a USB stick set up with Everyday Assistant and the local AI model it uses, for private chat. It costs $179, one time, and is sold only as a physical stick. It does not include Image Studio or a profession edition. Full drives are the Pocket, Rugged, and Premium options.

The drive needs a compatible Windows computer. The checkout page lists the requirements, and you confirm them before you pay. If your computer cannot run it, the money-back guarantee applies.

2. Prices and payment

  • Prices are in US dollars and are the ones shown at checkout when you pay. We may change prices for future orders at any time.
  • Payment is taken by PayPal, by PayPal balance, bank, or card. We never receive or store your full card number.
  • Your order is accepted when payment is complete and you receive our receipt email. If we cannot fill an order, for example because of an obvious pricing error, we cancel it and refund you in full.
  • Shipping to US addresses is free. Orders shipped to Texas include Texas sales tax; orders shipped elsewhere do not.

3. Delivery

We ship within the time stated in the shipping policy. Ownership of the drive and the risk of loss pass to you on delivery. If a package is lost or damaged in transit, we replace it.

4. Your license to the software

  • The Evolve AI dashboards, editions, and launchers on your drive are licensed to you for use by you or your organization on any computers you use, from that one drive. You may make backup copies of the drive for your own use.
  • You may not resell, rent, or share copies of the editions with people outside your household or organization, or remove the licensing notices.
  • The AI models and open-source components on the drive come under their own licenses, which are included on the drive. Nothing in these terms limits your rights under those licenses.
  • Your license continues for as long as you keep the drive. There is no subscription, and the software keeps working whether or not you buy updates.

5. AI-generated content

The editions draft text, images, scores, narration, and other material with AI models that run on your computer. AI output can be wrong, incomplete, or unsuitable. You are responsible for reviewing every draft before you rely on it or share it, and for how you use it. The drafts are suggestions and carry no professional, legal, financial, tax, or educational advice from us.

6. Updates

Bug and security fixes are free for every edition you own, for as long as we publish them. Feature updates and upgrades cost $99 per edition and are optional. Additional editions for a drive you own cost $149 each. Additional editions are sold only for full drives (Pocket, Rugged, or Premium); an Evolve Everyday stick cannot take them.

7. Evolve Everyday trade-up credit

  • When you buy an Evolve Everyday stick, you receive a $100 credit toward one full drive (Pocket, Rugged, or Premium) ordered within 90 days of your Everyday order.
  • The credit can be used once per customer, on one full drive order. It has no cash value, cannot be transferred, and cannot be combined with another credit.
  • You keep the Everyday stick after you trade up.
  • If you return the Everyday stick for a refund before using the credit, the credit ends. If you have already used the credit, we deduct $100 from that refund.
  • If you return the full drive bought with the credit, we refund what you paid for it, and the credit counts as used.

8. Guarantee and warranty

  • You may return any drive or Evolve Everyday order within 30 days of delivery for a full refund, as described in the returns policy.
  • We replace a defective drive free of charge for one year from delivery.
  • Beyond these promises and any rights the law gives you that cannot be waived, the drive and software are provided “as is.” We do not promise that the software is free of errors or that it will run on every computer.

9. Limitation of liability

To the extent the law allows, our total liability for any claim about an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential losses such as lost profits, lost data, or business interruption. Please keep your own backups of important work. Nothing in these terms limits liability that cannot be limited by law.

10. Privacy

The AI on your drive runs on your own computer, and your documents stay there. For orders we receive your name, email, shipping address, and payment confirmation from PayPal, and we use them only to fill, support, and account for your order. See the website privacy notice.

11. Disputes and governing law

  • If something goes wrong, please open a support ticket first. We will try to put it right quickly.
  • These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.
  • The state and federal courts in Harris County, Texas, have jurisdiction over any dispute, unless the law where you live gives you the right to bring a claim in your local courts. These terms contain no arbitration requirement, and nothing in them limits your rights as a consumer.

12. Changes to these terms

We may update these terms for future orders. The terms in effect when you placed your order apply to that order.
